Booking Terms + Conditions

When a booking for a majestic disorder travels trip is made, it is hereby confirmed of understanding and agreeing to the terms and conditions listed in this agreement.

1. Agreeing Parties

1.1 majestic disorder travels is a trading name of majestic disorder travels Ltd with its registered office at 72 Pennard Road, unit 3, London UK, which is hereby defined in this agreement as “Company.”

1.2 The person making the booking, which can be the person in addition to accompanying paying persons who will be in attendance of the majestic disorder travels trip per the booking made, are hereby defined in this agreement as “Travellers.”

1.3 The travel experiences offered by majestic disorder travels and transacted between the Company and Travellers is hereby defined in this agreement as “Trips.”

1.4 The price of Trips is excised per each Travellers attending Trips.

1.5 This legally binding agreement is between the Company and Travellers whom confirm acceptance of the terms and conditions in this agreement when a booking for Trips is made.

2. Trips Payment

2.1  All Trips require a non-refundable deposit of 40% of Trips cost to reserve the Travellers spot on Trips.

2.2 Split payments are offered to Travellers on group trips who book more than 45 days prior to Trips starting date.

2.3 The balance for Travellers on group trips booking on split payments is due 45 days prior to Trips starting date.

2.4 The balance for Travellers on group trips booking a single room on split payments is due 60 days prior to Trips starting date.

2.5 For Travellers booking Private Trips, the remaining balance is due 60 days prior to the Trips starting date.

2.6 If a booking is made within 45 days of Trips starting date, full payment is due at the time of booking (or 60 days prior to Trips starting date if booking a single room).

2.7 For Travellers on split payments, if the payment balance is not received by the Company on the final due date, Trips availability for the Travellers is not guaranteed and is susceptible to additional fees excised by the Company and/or a credit applied to attend Trips on a future date.

2.8 Travellers spot on Trips is confirmed when the full Trips due amount has been paid to the Company.  

3. Payment Transaction

3.1 The price of Trips is inclusive of the confirmed itinerary, taxes and other such costs outlined in this agreement.

3.2 All payments transacted will be in the currency Great British Pound (GBP) Sterling.

3.3 If the Travellers payment method is not denominated in GBP, the final price will be calculated in accordance with the applicable exchange rate on the day the transaction is processed.

3.4 Travellers hereby accept any and all exchange rate or transaction fees issued by their financial institution.

4. Cancellation by Travellers

4.1 In the event Travellers on group trips wish to cancel their booking, regardless of reasoning or circumstances, the deposit of 40% of Trips cost is non-refundable.

4.2 In the event Travellers on group trips who did not purchase a single room wish to cancel their booking, the following monetary refund options are available:

a). If Travellers cancel their booking 75 days prior to Trips starting date, of the paid amount, the deposit is non-refundable, but any other payment sum made by Travellers will be refunded.

b). If Travellers cancel their booking no later than 46 days prior to Trips starting date, the deposit of the paid amount is non-refundable, but any other payment made by Travellers will be 50% refunded.

c). If Travellers cancel their booking within 45 days prior to Trips starting date, no refund will be provided.

d). If Travellers wish to cancel their booking, per the discretion of the Company and if Travellers wish to do so, Travellers can transfer their booking to another person at no additional cost, provided Trips total cost is paid.

4.3 In the event Travellers on group trips who purchased a single room wish to cancel their booking, the following monetary refund options are available:

a). If Travellers cancel their booking 90 days prior to Trips starting date, of the paid amount, the deposit is non-refundable, but any other payment sum made by Travellers will be refunded.

b). If Travellers cancel their booking no later than 76 days prior to Trips starting date, the deposit of the paid amount is non-refundable, but any other payment made by Travellers will be 50% refunded.

c). If Travellers cancel their booking within 75 days prior to Trips starting date, no refund will be provided.

d). If Travellers wish to cancel their booking, per the discretion of the Company and if Travellers wish to do so, Travellers can transfer their booking to another person at no additional cost, provided Trips total cost is paid.

4.4 In the event Travellers on group trips, both who did and did not purchase a single room, wish to cancel their booking, the following credit options are available:

a). If Travellers cancel their booking 61 days prior to Trips starting date, of the paid amount, can be credited as a deposit to future Trips, per the discretion of the company.

b). In the event a credit is applicable, it is valid for a 12-month period from the date of issuance. If the Traveller does not use it in the 12-month period, the Traveller forfeits any further refund or credit option.

c). An issued credit can only be moved to Trips once in the valid 12-month period. If the Traveller requests to move the credit a second time, the Traveller forfeits any further refund or credit option.

d). In the instance of a Traveller using a credit, it is possible the future Trips selected to attend could be at a higher price then what they originally booked. The Traveller agrees to complete the full payment of the listed price on the Trips they will attend in the valid 12-month period.

4.5 In the event Travellers on private trips with to cancel their booking, the following refund options are available:

a). If cancelled at any time, the Travellers deposit is non-refundable.

b). If Travellers cancel their booking at least 61 days prior to Trip starting date, the deposit of the paid amount is non-refundable, but any other payment made by Travellers will be 50% refunded.

c). If Travellers cancel their booking within 60 days prior to Trip starting date, no refund will be provided.

4.6 In the event Travellers cancel their booking, regardless of reasoning or circumstances, the Company is not liable for any incidental costs, refunds or damages incurred by Travellers, such as but not limited to, airfare, passport and visa fees, vaccinations, hotel stays, etc…

5. Cancellation by Company

5.1 The Company reserves the right to cancel Trips at any time prior to Trips starting date.

5.2 If the Company cancels Trips after receiving any and/or total payment from Travellers, per the discretion of the Company, Travellers will be offered an option to apply credit to booking towards future Trips.

5.3 In the event Trips are cancelled by the Company due to circumstances, such as but not limited to, those described under Force Majeure with third party suppliers, refunds to Travellers will be provided for recoverable costs by the Company. Refunds will not include any unrecoverable costs, such as non-refundable deposits, in the unlikely event any occur.

5.4 In the event the Company cancels Trips, the Company is not liable for any incidental costs, refunds or damages incurred by Travellers, such as but not limited to, airfare, passport and visa fees, vaccinations, hotel stays, etc…

6. Special Needs

6.1 It is the responsibility of Travellers to inform the Company prior to booking Trips of any special needs they have, such as but not limited to, dietary requirements, allergies, limited mobility, visual and/or hearing impairments, etc…

6.2  The Company will do its best to accommodate any and all special needs notified prior to booking, but it is possible in order to suffice Travellers special needs, additional costs will be excised.

6.3 Travellers will be notified of any additional costs applied for special needs prior to booking, if the Company is notified.

6.4 In the event the Company is notified to accommodate special needs after a booking has been made, and additional costs will be applied, Travellers accept these costs. Travellers refusal to cover these costs in this circumstance, will forfeit entitlement to any and all refunds.

7. Personal Requirements

7.1 All Travellers must be 18 years old or older.

7.2 The Company reserves the right to decline service to any potential Travellers who is under the age of 18.

7.3 In the event the Company accepts Travellers under the age of 18, the Travellers must be accompanied by their legal guardian.

7.4 Travellers acknowledge absence of physical, mental, other conditions or disabilities that would create a hazard to themselves or accompanying Travellers and/or Company personnel, third party suppliers.

7.5 The Company reserves the right to remove Travellers from Trips for such instances, but not limited to, if Travellers are responsible for detrimental impact to themselves, accompanying Travellers and/or others.

8. Inclusions and Exclusions

8.1 Included within Trips are the costs for all activities, tours and workshops specified within the detailed itinerary sent to Travellers after completing payment of Trips.

8.2 Transportation to all items in the itinerary are included in Trips.

8.3 Transportation to Marrakech airport or hotel is not included for Travellers on early arrival prior to Trips starting date or later departure after the final day of the Trips, unless their extension is a Private Trips organised by the Company.

8.4 All meals during Trips are included, unless otherwise specified within the itinerary.

8.5 Airfare and/or transit to Marrakech, Morocco for Trips is not included.

8.6 Ancillary costs, such as but not limited to, travel insurance, vaccinations, passport and/or visa fees if applicable, etc… are not included in Trips.

8.7 Special needs costs, such as but not limited to, dietary requirements to be supplemented with food, private rooms for individual Travellers, etc… are not included.

9. Trips Itinerary Changes

9.1 The Company reserves the right to cancel, alter or modify Trips itinerary, including but not limited to, schedule structure, suppliers, accommodations, transportation and guides, without prior notice to Travellers for any reason. In the event thereof, no further refund or compensation to Travellers will be provided.

9.2 The Company reserves the right to alter the prices of any Trips shown on its website before Travellers booking is confirmed. Travellers will be advised of the current price before booking is confirmed.

9.3 The Company reserves the right where any costs cannot be reasonably calculated by the Company in advance of the final due balance of Travellers, the Company will give notice of any additional costs Travellers may still have to bear.

10. Travel Insurance

10.1 Obtaining travel insurance for Trips is compulsory.

10.2 It is per the discretion of Travellers to obtain an appropriate insurance coverage package to provide coverage for such instances, but not limited to, personal accident, death, medical expenses, repatriation, emergency evacuation, personal liability, loss of luggage, personal effects, flight cancellation, etc…

10.3 Company Trips can be cancelled at any time for any reason, it is the responsibility of Travellers to verify insurance policy details to ensure coverage and reimbursement if needed.

11. Passport and Visa Entry

11.1 Possession of a valid passport is the responsibility of Travellers whereby each passport should be valid for three months beyond Travellers departure date from Morocco.

11.2 Verifying if Travellers need a visa to enter Morocco is the sole responsibility of Travellers, whereby if a visa is required, they will need to arrange for completion of all necessary requirements for a successful application and secure the visa before their departure date to Morocco.

11.3 The Company is absolved from any and all costs related to Travellers having to secure a valid passport and/or visa to enter Morocco.

11.4 Travellers accept sole liability if they are refused entry to Morocco for any reason or stay beyond the legal length of stay per their visa.

12. Covid-19 PROTOCOL

12.1 It is the sole responsibility of Travellers to review and comply with the covid-19 travel requirements for each part of their journey, including entry into Morocco.

12.2 Travellers accept sole liability if they are refused entry to Morocco or any transiting country for any reason.

12.3 Travellers agree that only an accredited laboratory in Morocco can provide certified covid test results.

12.4 In the event a Traveller tests positive for covid whilst on a trip, the Traveller agrees to self-isolate and will not be permitted to re-join the group until they have a negative covid test result from a certified lab.

12.5 In the event of 12.4, Travellers will have to pay applicable costs for covid tests, private transport, accommodation, etc…

12.6 In the event a Traveller tests positive for covid whilst on a trip, the rest of the Travellers on the trip will need to have a negative test result from a certified Moroccan lab in order to continue forward with the group. Travellers will have to pay the applicable cost for the test.

12.7 The Company is absolved from any and all costs and liability related to Travellers testing positive for covid-19 whilst on a Trip.

13. Limitation of Liability

13.1 Travellers accept any and all liability that Company Trips can involve activities, some in remote areas, with a risk of injury and/or death that may be caused by such instances, but not limited to, forces of nature, third party conduct or contact that is either known or unknown or willful or un-willful, negligence on behalf the Company and/or negligence upon its third party suppliers.

13.2 Travellers accept that medical services and/or administrative facilities may not be readily available or accessible during some or all of the time during Trips.

13.3 The Company is not responsible nor liable for any injury, loss or damage to person or property, death, delay or inconvenience in connection with Trips and/or journey towards or onwards from Company. Travellers hold the Company harmless for any and all damages incurred.

13.4 The Company does not own, operate or in control of third party suppliers providing goods and/or services for Trips, including such as but not limited to, airlines, hotels, transportation vehicles and operators, food and beverages, experiential craft, etc...

13.5 Travellers absolve the Company from any and all liability resulting in any injury, loss or damage to person or property, death, delay or inconvenience in connection with the provision of any goods and/or services provided by third party suppliers in connection with Trips.

14. Optional Activities

14.1 During Company Trips there may be opportunities for Travellers to participate in activities or local events that are not included in the Company’s Trips itinerary.

14.2 The Company makes no representation about the safety or quality of these activities and events or the standard of the independent operator running it. Travellers participation in non-Trips itinerary is done solely upon the discretion of the Travellers accepting any and all liability.

14.3 If Company group leader(s) and/or local representative(s) provide any assistance for Travellers in arranging their participation in any such non-Trips itinerary, Travellers hereby absolve the Company for any and all liability, including but not limited to, any injury, loss or damage to person or property, death, delay or inconvenience in connection with participating in non-Trips itinerary.

15. Exiting Trips

15.1 The Company will best accommodate Travellers who must exit Trips for emergency personal and/or extenuating circumstances. Travellers accept sole responsibility, liability and applicable costs for their return journey.

15.2 Company reserves the right to remove Travellers from Trips at any time for any reason, such as but not limited to, discriminatory, disorderly and/or criminal behavior directed towards, but not limited to, Company personnel, third party suppliers, accompanying Travellers, local community.

15.3 If Travellers exit Trips per Company mandate. Travellers accept sole responsibility, liability and applicable costs for their return journey.

16. Force Majeure

16.1 No party to this contract shall be held in any way responsible for any failure to fulfil its obligations under this contract if such failure has been caused (directly or indirectly) by circumstances beyond the control of the defaulting party. This shall include, but not limited to, pandemic, war, riot, acts of terrorism, natural disaster, industrial action, accident (except where such circumstance has been caused by the negligence of the defaulting party).

17. Media Use

17.1 Travellers hereby acknowledge, consent and agree that by participating on Company Trips, they will be photographed, videoed and/or digitally recorded, defined herein “Content,” to be published on Company platforms and its subsidiaries in existence or hereafter developed. Travellers grant royalty-free perpetual license, if any and all possessive likeliness is used in Content published.

17.2 Content is permissible to be published on third party platforms for the promotion of the Company. Travellers grant royalty-free perpetual license, if any and all possessive likeliness is used in Content reproduction. 

17.3 Content created by Travellers is permissible to be published on personal platforms. The Company reserves the right for permitting Content published to commercial platforms owned and/or represented, affiliated, associated with Travellers.

17.4 Content created by Travellers featuring possessives likeliness of other Travellers must have consent.

17.5 In the event of 17.4 where a Content of a Traveller is used by another Traveller without consent, Travellers absolve the Company from any and all liability.

18. Update Terms

18.1 The Company reserves the right to update and/or amend these terms and conditions at anytime.

19. Legal Venue

19.1 Any agreement made under these terms shall be deemed to have been made in England according to English laws.

19.2 Any claim or matter arising under or in connection with such agreement and/or these terms shall be subject to the jurisdiction of the English courts.

19.3 If the Company must pursue a legal claim and is successful with a favourable judgment against Travellers in a court claim, Travellers agree to pay for any and all legal costs and court fees the Company incurs.
